Usufruct

Long-term lease

Under the lease, you get access to a residential place for a short period. The estimated duration for these contracts is 25 years, depending on the agreements between the parties.

How to Buy a Property in Abu Dhabi?

You have to go through the following steps to buy any real estate property in Abu Dhabi:

Research Phase

This is the most important step for buying any sort of property in Abu Dhabi. Here, you have to discuss all the available alternatives in the desired location, their costs, the attractions, etc. Hiring a real estate agent for in-depth market analysis and evaluation may make this process easy and fast.  Also, search neighborhoods and top developers’ listings on online portals. This way, you can compare all choices for the best results. While looking for prices, consider the maintenance cost of different residential properties.

Initial Agreement

Before finalizing any property-related translation, a preliminary contract is signed by both the potential buyer and the seller. This contract is mostly made in Arabic with the help of a professional lawyer. Moreover, it includes all the necessary details, such as the address of the building, the roles of buyer and seller, the transaction amount finalized between the parties, and the terms and conditions related to the payment. After finalizing the preliminary agreement, the next step is finalizing the MoU.

Memorandum of Understanding (MoU)

This is a purchase and sales agreement finalized by both parties, which remains valid for 30 days.  At this moment, the buyer will provide a certain amount of the transaction price ( usually 10 percent) as a pledge to show his serious intention to buy. In case of a complete transaction, this amount is returned to the buyer at the end. In case of failure, the amount will remain with the seller. In case the transaction remains incomplete because of the seller, then he will provide compensation in the form of double the amount of deposit provided by the buyer as a pledge.

NOC / No Objection Certificate

This step involves the developer’s office, where both parties come to get a No Objection Certificate.

This certificate shows that the developer does not object to the transfer of ownership rights to the buyer and that the seller does not have any pending debts toward the developer. This certificate is an important part of buying and selling ready-to-move properties in Abu Dhabi.

Ownership rights

Both buyer and seller request the Abu Dhabi Land Department to transfer ownership rights. This is done after receiving NOC from the developer. This department will issue a payment receipt to the buyer, who has to submit the amount. After payment, he will get a Title Deed showing his ownership rights towards the property. Now, he is the official owner of that residential place.

Getting a Mortgage

In case of a shortage of funds, the most reliable option is getting a mortgage from any bank in Abu Dhabi. To avail of this offer, the buyer must provide his pay slip from his employer, six months’ bank statements, and a copy of his passport along with a photo and the visa page. He also needs to submit a copy of his Emirates ID and proof of residence to the bank. Upon submitting all the documents, the bank will evaluate the fair price of the property for which it provides the mortgage. After the scrutiny, it will issue a cheque to transfer funds and provide it to the seller.

Important Documents

Other than the Sales Agreement and NOC certificate, the following documents are required by the buyer for the successful transaction:

  • Original passport
  • Visa, representing his current location in UAE
  • Power of attorney showcasing the agent selected by the buyer in his absence.

Overall Costs and Expenses

During the buying process, you have to pay the following costs along with the amount of transaction of property price:

  • There is a registration fee if you use an online portal for buying transactions. It is 2 percent of the total purchase price. There is no registration fee if you deal directly with developers.
  • A Commission Fee is paid to the real estate agent, which is 2 percent of the total purchase price.
  • The mortgage arrangement fee is the amount you pay to the financial institute from which you availed the mortgage.

Choice of Off-Plan and Ready-to-Move Properties

Ready-to-move Properties are residential projects that have already been completed, and you can move as soon as the transaction is completed. These properties are available at higher prices, but you don’t have to wait to enjoy them.

On the other hand, off-plan properties are projects that are still under construction, and you have to wait to shift to them even after getting ownership rights. The perk of considering them is their affordable price as compared to Ready to Move properties. Moreover, their buying process involves the Initial Contract of Sale between the buyer and the developer. You don’t have to work for NOC or MoU, so it is quicker than the first one.

Residential Property Type

You have to decide which type of residential property is suitable for you. However,  you can search for studios, 1-bed apartments, and 2. Bed apartments or spacious living places like villas or townhouses. For singles who are looking for comfortable yet affordable property, a studio is best.
